Hello, I'm a citizen of Israel and I am currently visiting the Czech Republic.
Yesterday I was stopped by the police in Brno. i was given alcohol test that was negative, and the policeman insisted on the drug test and threatened me that if I don't agree he will confiscate the car I was driving and give me a 50,000 CZK fine. The test was also negative but the policeman decided the test was faulty so he called the traffic police that again threatened me in order to take another test, even though I said I already did one. this test was positive for cannabis, even though I didn\'t smoke the same day, only the evening before. Than I was taken to give a blood sample and the police took my Israeli driving license and 20,000 CZK bale. The doctor that checked me said I looked fit and after talking with the policeman, he admitted that his decision to insist on drug test wasn't because of how I looked, but because of the look of the hitchikers that were in the car. I feel the police didn't give me a fair treatment and as a result I cannot drive now and I am expecting a big fine.
I would like to know if there is something I can about it.
Best regards,
Asaf
Dear Mr. Asaf,
it depends on the result of the test of the blood sample, because the presence of the active or inactive metabolites of THC can be distinguished only from blood analysis. Usually, there are no active metabolites in the blood after more than 12 hours. Inactive metabolites can be detected weeks ago and their presence is not a proof, that you are under influence of drugs. You should wait for the results of the blood analysis and then choose the kind of your defence. Regarding police procedure, police is authorized to require the driver to submit to a drug test. In my opinion, there is no non-standard procedure in police behavior in this point. I don´t understand, what do you mean with "20000- CzK bale". It will be against law to demand this amount by driver on the street.
Best regards,
